Regulated under Health Canada and enforced by the criminal justice system, the Controlled Drugs and Substances Act establishes a legal framework to monitor and prevent possession, assembly, import and sale of controlled drugs and the chemicals used in their production. Classified under the Drug Schedule (I-VII) substances are separated by severity and quantity, and penalties range throughout the schedule. Severity of penalty often depends on the quantity of the substance involved as well as the intent and history of the accused.

The government’s aim to be tough on drug sentences including minimum sentences has slowly been evolving in Canada and many penalties can be decreased. There is now new progression towards harm reduction strategies including supervised use and protection from criminal charges with lessening penalties for drug use. In many cases Canada’s drug laws can be argued to focus on rehabilitation over imprisonment.
